Electronic Disclosure - Opportunity or Threat Civil litigation involving the disclosure of electronic documents is often seen as complex and costly. Whilst it is true that there are technological issues to address and overcome, these are quite achievable by a specialist in the field and the process offers many benefits to the court and litigator alike. The historical multi-stage method of converting electronic documents to a paper format, sifting and scanning the documents back into another electronic format (leaving behind in the process all of the associated meta data) is, putting it bluntly, costly, ineffective and a waste of time and resources to produce, at best, barely adequate results. To submit only that which can be seen on a printed document as the sum of the information available, is no better than photocopying only one side of a document printed on both sides, and presenting this under claims of full disclosure. The process of sifting through the electronic documents, sorting, categorising and deduplication is both thorough and, when compared to the analysis of paper documentation, extremely quick and therefore cost effective. The process will capture not only the information that would have been presented if the document were printed in paper format, but also the meta data from these documents, documents thought long deleted, and the trail of times and dates associated with the creation, modification, saving and distribution of the document. To those members of the legal profession who embrace this technology, it provides them with a previously untapped source of information which is both certain, auditable and demonstrable to the layman, thus giving a powerful weapon to use in the pursuit of their cause. |
